Comment on the European Union’s proposals on patients’ rights to cross border healthcare from Dr Peter Carter, Chief Executive & General Secretary of the Royal College of Nursing (RCN).

After repeated delays, the proposal for a Directive on patients rights regarding cross-border healthcare was released on 2 July 2008. With the proposal, the Commission will try to create legal certainty on this issue and possibly avoid new court cases because the EU Treaty gives individual patients the right to seek healthcare in other Member States.

An amendment asking the reintroduction on health services in the ’services directive’ was voted AGAINST by the European Parliament. EPHA and 7 leading health organisations sent a letter (attached) to Members of the European Parliament urging the Parliament to oppose this amendment.

The European Parliament has adopted its own-initiative report on Social Services of General Interest.
The report makes clear that SSGIs are one of the pillars of the European Social model.

In June 2006, Ministers of Health of the 25 Member States adopted common values and principles which are to guide EU health systems.
The conclusions of the Council follows the exclusion of healthcare services from the scope of the Services Directive and foresees the future Community framework on health services, currently developed by the European Commission.

According to OECD Health Data 2006, health spending continues to rise in OECD countries, growing faster than GDP in every OECD - Organisation for Economic Co-operation and Development - country (except Finland) between 1990 and 2004.
