On 30 October 2003 the Italian Presidency asked the groups of legal experts from the EU institutions to examine a new series of issues from the draft Constitutional treaty that need clarification. The experts have a tight deadline and have been convened to meet on 11-12 November 2003 to deliver an answer on these questions.

The latest mandate for the experts covers questions such as the whether Article 10 on primacy of EU law reflects ECJ jurisprudence.

- On public health, the lawyers have been asked by the Finnish government to clarify the relationship between free movement of services or service provision with Member State responsibilities for the organisation and delivery of health services. The Commission also requested that the text of Article III-179 paragraph 4 be brought into line with Article I-13 (shared competencies).

- The Swedish government asked for guidance on whether the Treaty provides a sufficient legal basis to implement the Consumer Policy Strategy and whether paragraph 4 diminishes the impact of the article as a base for consumer legislation (Art. III-132).

In September 2003 the first report of the IGC legal experts provided an overview of linguistic and editorial amendments to the Constitution treaty drafted by the Convention.
